About This Book
This book by Hernando Barboza Russian refers to the process of constitutional review of sentences that in Venezuela managed to transform the constitutional justice system, going from a mixed system of constitutional control to a truly comprehensive system, in which the review of sentences has made it possible to give meaning, coherence and uniformity to constitutional protection. Although its incorporation came to complement one of the oldest Latin American systems of protection and guarantee of the Constitution; It also resulted in the body in charge of exercising this attribution, the Constitutional Chamber of the Supreme Court of Justice, having emerged as an unprecedented authority in the Venezuelan legal order. The Constitutional Chamber, in the absence of legislative regulation, has outlined a dangerous path along which it has traveled for more than twenty years, in which it has clearly established that it, as the last and highest constitutional interpreter, has no limit in the exercise of its functions and, in the case of the review of sentences, it has regarded it as an absolutely discretionary power on which it is not obliged to pronounce; explaining that this figure cannot be understood as a right of the individual. Thus, the purpose of this book is to carry out a critical analysis of the constitutional review of judgments and to present arguments that would lead to dismantling part of those characteristics that the Constitutional Chamber has attributed to this figure, presenting an alternative so that it can be considered as an appeal of the individual, without this suppressing its main purpose, which is the coherence and uniformity of the system.
