About This Book
The purpose of this book is to examine, from a legal perspective, the administrative-health management of the pandemic known as Covid-19 by various European and American countries during the years 2020, 2021, and 2022. For this, various legal frameworks were analyzed in health matters, as well as the traditional doctrine and jurisprudence regarding the patrimonial liability of the State, with a focus on the specific case of the pandemic by going to press releases, scientific journals, medical reports of the World Health Organization (WHO), to approach certain conclusions regarding the relevance and temporality of the actions adopted by the countries examined considering the warnings that came from the WHO, from the notorious facts, as well as from the opinion of specialists.
Some measures commonly adopted by these countries were considered, among them, states of alarm with a focus on the State's liability regime, logically considering the causes of exoneration/exemption of liability, such as the case of force majeure. Likewise, the vaccination campaign against Covid-19 will be examined specifically in countries such as the United States, Italy, Spain, and Venezuela, to obtain a comparative balance not only of legal regulations but also of effects on fundamental rights, in addition to the effectiveness of health actions, taking into account both the positive and negative effects of these health campaigns.
