About This Book
This book of Professor Mauro Mezza, examines the system of constitutional and public law in France, moving from the diachronic study of transalpine institutions, considered from the dividing line represented by the revolutionary events of 1789. The changes in positive law are framed in the evolutionary context of constitutional theory. The fundamental principles of the republican constitutional order, as well as the recognition and guarantee of fundamental rights and freedoms, are the object of analysis, with comparative references to the main experiences of the Western legal tradition (especially the parliamentary regime and the constitutional system of the United States of America). The institutional system of the Fifth Republic is then analyzed, both with respect to the legislative and executive powers, as well as to the jurisdictional function, the latter referring to both the dimension of constitutional justice and that of the ordinary jurisdiction and the contentious-administrative sector. In addition, the system of territorial autonomies or collectivities (metropolitan and overseas) is examined, with the aim of delving into the peculiar characteristics of the transalpine model of political-administrative decentralization. From the perspective of vertical comparison, essential from the orientations of comparative methodology applied to public law research, the relations between the legal system of France and the European Union will also be analyzed.
