About This Book
This book by Professor Allan R. Brewer-Carías, is a compilation of all his critical opinions on the Constitution of Venezuela of 1999, expressed and published 25 years ago, both in press statements and in documents, when it was being discussed, approved and beginning to be implemented.
The various texts and works have been grouped into the following eight parts. PART ONE, Opinions on the Draft Constitution expressed in the Press (1999-2000); PART TWO: Document on the Reasons for the "NO" Vote in the Referendum on the Constitution, published on November 30, 1999; PART THREE, Opinions on the Failure of the Constituent Process as an Instrument of State Reform, which includes: (i) Opinions in the Press during the campaign for the Referendum Approving the Constitution (1999); (ii) Appreciation of the Constituent Process and the Failed Reform of the State (2001); and (iii) Study on the Situation and Perspective of the Constitutional Contradiction between a "Decentralized Federal State" and the Centralization of the Federation (2003); PART FOUR: "The Transitional Regime that Suspended the Application of the Constitution (2002); PART FIVE: The Laws that were Necessary to Implement the Constitution (2000); PART SIX: First Critical Academic Reflections on the 1999 Constitution, which includes (i) Reflection in Austin, Texas, on the Venezuelan Constituent Process and the new Constitution of 1999 (2000); and Reflections in Caracas, on the 1999 Constitution (2000); PART SEVEN: The Illegitimate Modification of the Constitution with its Republication in 2000, which includes: (i) Opinions in the press (2000) and analysis of the New Publication of the Constitutional Text of 24-3-2000 with Unconstitutional Modifications; and PART EIGHT: On the First Notorious Violations of the Constitution, which contains: (i) Opinions in press statements (2000-2001), and the study on The Kidnapping of Citizen Participation in the Designation of the Heads of the Non-Elected Bodies of the Public Powers (2004).
