About This Book
This book by Professor Allan R. Brewer-Carías deals with the right to democracy, in its two aspects, as an individual right and a collective right of all citizens in a State governed by the rule of law, as has been outlined in the doctrine of the Inter-American Court of Human Rights, in particular in the judgments of the Case of Capriles v. Venezuela of October 10, 2024, which analyzed the violations of electoral guarantees and judicial protection in the 2013 Venezuelan presidential election (Part One); and the Case of Chirinos Salamanca v. Venezuela of August 21, 2025 (Part Four), in which the lack of democratic guarantees in the process of denunciation of the American Convention on Human Rights by Venezuela was analyzed and rejected, declaring that the Convention never lost its validity in the country.
The book also contains some general reflections on the subject of the right to democracy, participation and representation today (Part Two), and some Notes on the Distortion of Democracies (Part Three).

As a Portico, Professor Brewer-Carías' Opinion on the Right to Democracy filed as an amicus curiae before the Inter-American Court of Human Rights on October 27, 2025, in support of Guatemala's request for an Advisory Opinion in December 2024 on whether democracy is a human right.
As a Prologue, the study by [professor Asdrúbal Aguiar presented as a Memoire on the right to democracy and democracy as a right, in September 2025, before the Inter-American Court of Human Rights as support for the aforementioned Advisory Opinion requested by Guatemala on the right to democracy.
