About This Book
In Latin America and especially in Venezuela, in recent decades a populist narrative based on the deconstruction of the constitutionally enshrined institutional and democratic order has dangerously developed. This deconstructive populism or neo populism has become an aggression and a latent threat to constitutional democracy in many Latin American countries. Faced with this reality, the author of this book, professor Juan Manuel Raffalli Arismendi intend to answer two specific questions: How could International Law functionally interacting with the internal order support the restitution of constitutional democracy and the human rights that it guarantees? Is possible to give greater effectiveness to this dual functionality between International Law and internal order? for this purpose, we justify the application of International Law and especially the mandatory rules of ius cogens as well as those of positive law, as useful tools in the constitutional restitution process in light of the Venezuela case, and its systematic and interactive application with the internal order. In this sense, we evaluate the success and errors in the Venezuela case and propose some ideas to improve the effectiveness of this interaction of both orders in pursuit of true constitutional restitution.
