About This Book
This book by Professor Mauricio R. Pernía-Reyes, which includes several of his studies on Mining Law, analyzes the mining industry from different legal perspectives, both traditional and in the light of new categories of study applicable to the sector. To this end, the work examines the administrative functions of the State regarding mines as public property; the techniques of administrative intervention in the mining activities; mining contracting and in particular, mining concessions and the joint venture regime established in recent legislative changes. It also analyzes the regime of special mining advantages and their legal nature and the resolution of conflicts arising during extractive activities, and the legislation on foreign investment. Likewise, this work presents the analysis of the new requirements in the standards global extractive industries and Mining Law in terms of transparency and access to public information; tensions and relationships arising from licenses social and environmental for the granting of mining concessions or contracts against the principles of market unity and decentralization; the development of infrastructures for mining activities and the linking of municipalities in the mining.
